Tropicana Field in St. Petersburg is home to the Tampa Bay Rays. After Hurricane Milton damaged the roof in October 2024, the Rays played the 2025 season at Steinbrenner Field in Tampa, then returned to the repaired Tropicana Field for the 2026 season. The ballpark seats about 25,000 for baseball and also hosts concerts and other events.

Most people enjoy a safe, fun event. But big crowds mean a big law enforcement presence, and alcohol and excitement can turn a small problem into an arrest. If you or a friend or family member was arrested at Tropicana Field, here is a general overview of what to expect.
Tampa Bay is home to the Buccaneers, the Lightning and the Rays, and to concerts that bring tens of thousands of fans to a single venue on a single night. Most people have a safe, fun time at these events. But when a large crowd gathers, there is a large law enforcement presence too. Add alcohol, heat, long lines, team rivalries and the excitement of the event, and some evenings end with an arrest.

If you or a friend or family member was arrested at Raymond James Stadium, Benchmark International Arena (formerly Amalie Arena) or Tropicana Field, this page explains, in general terms, what usually happens next and why the location of the arrest matters.

Why Big Events Lead to Arrests

Stadiums and arenas are monitored closely. Officers from local agencies, private security, and event staff work together, and cameras cover entrances, concourses, seating areas and parking lots. Something that might be ignored somewhere else, like a loud argument or refusing to leave a section, can quickly lead to police involvement inside a venue.

Common situations include:

Arguments between fans that turn physical

Being asked to leave and refusing, or coming back after being ejected

Heavy drinking before or during the event

Driving away from the venue after drinking

Bringing drugs into the venue or the parking lot

Problems with tickets, including counterfeit or resold tickets

Common Charges at Games and Concerts

Every arrest is based on its own facts, but charges that come up at large events often include:

Disorderly conduct (Florida’s breach of the peace statute, section 877.03)

Disorderly intoxication (section 856.011)

Trespass, including trespass after a warning when someone is told to leave or not to return (see section 810.09 and related trespass laws)

Battery and other violent crimes

Resisting an officer

DUI after leaving the stadium or arena lots

Drug possession

Ticket fraud or counterfeit ticket issues

Many of the people arrested at these events have never been arrested before. If that describes you or a friend or family member, read about how Florida courts handle first-time offenders.

Where the Arrest Happened Decides the County

The county where an arrest happens decides which jail, which court and which procedures apply.

Tampa venues: Hillsborough County

Raymond James Stadium (Buccaneers, college football and major concerts) and Benchmark International Arena (Lightning hockey and concerts) are in Tampa. An arrest at either venue or the surrounding area is generally a Hillsborough County case. People arrested in Hillsborough County are typically booked at the Orient Road Jail, then go through first appearance, bond and arraignment.

Arrested at Raymond James Stadium

Arrested at Benchmark International Arena (formerly Amalie Arena)

Arrested at the Tampa Convention Center

Bond and bail in Hillsborough County

First appearance in Hillsborough County

Arraignment in Hillsborough County

St. Petersburg venue: Pinellas County

The Rays returned to Tropicana Field in St. Petersburg for the 2026 season after playing the 2025 season at Steinbrenner Field in Tampa. An arrest at Tropicana Field or the surrounding area is generally a Pinellas County case, which follows Pinellas County procedures for booking, first appearance, bond and arraignment.

Arrested at Tropicana Field

Bond and bail in Pinellas County

First appearance in Pinellas County

Arraignment in Pinellas County

What Happens After an Arrest at a Venue

The details vary, but the general path looks like this:

Detention and arrest. Security or officers may detain a person inside the venue or in the parking area. Some minor matters end with an ejection or a notice to appear; others lead to a custodial arrest.

Booking. The person is taken to the county jail, where they are fingerprinted, photographed and processed.

First appearance. A judge reviews the arrest and addresses release and bond conditions.

Bond. Bond may be set by a schedule or by the judge. Conditions can include no contact with an alleged victim, staying away from the venue, or other restrictions.

Arraignment and court dates. The person is formally advised of the charges and enters a plea, and the case moves forward from there. To learn more, see what an arraignment is in Florida.

Arrested While Visiting From Out of Town

Big games and concerts draw fans from across Florida and from other states. An arrest far from home raises its own questions:

How do I get out of jail quickly so I can make my flight?

Can I go home to another state while the case is open?

Do I have to come back for every court date?

What happens to my rental car or my travel plans?

Release conditions and court requirements can affect whether and how a person may travel. In some cases, a lawyer can ask the court about travel or about appearing through counsel. Because these rules depend on the charge and the court, talk with a lawyer before you make travel decisions.

Protecting Yourself After an Arrest

If you face any stop, search, seizure, inquiry, investigation, arrest or target letter, contact a lawyer before you answer questions or make decisions about your case.

Be polite with officers and staff, keep your court paperwork, and write down what you remember about the event, including where you were sitting, who you were with, and the names of any witnesses.

Mortgage fraud allegations can come from almost any part of buying, selling, or refinancing a home, from a loan application and supporting paperwork to an appraisal, a closing, or a document filed with the county clerk. These cases are often investigated for months before anyone is charged, and the same facts can lead to charges in Florida state court, in federal court, or both.

This post explains in general terms how mortgage fraud cases are handled under Florida law and in the federal system, at the time of this writing. Every case is different, so if you or a friend or family member is facing a mortgage fraud investigation or charge, call Attorney Ron Frey right away for a free, confidential consultation by phone, by video, or in person. Call or text Call or Text (813) 775-2276 or (844) 766-3739.

The Laws Involved

Florida: Section 817.545, Florida Statutes, mortgage fraud. It generally addresses knowingly making or using material misstatements, misrepresentations, or omissions in the mortgage lending process with intent to defraud.

Federal: 18 U.S.C. § 1344, bank fraud. It generally addresses schemes to defraud a financial institution.

Federal: 18 U.S.C. § 1014, loan and credit applications generally; renewals and discounts; crop insurance. It generally addresses false statements made to influence certain lenders, including mortgage lending businesses.

Federal: 18 U.S.C. § 1343, fraud by wire, radio, or television. It generally addresses schemes to defraud that use interstate wire communications.

Laws change, so contact Attorney Ron Frey about how any of these may apply to your case.

Who Can Be Accused?

Mortgage fraud allegations aren’t limited to borrowers. Florida’s law covers anyone involved in the mortgage lending process, which can include buyers, sellers, loan officers, brokers, appraisers, title and closing professionals, and others who handle the documents. Talk with Attorney Ron Frey about where you or a friend or family member may fit in an investigation.

State or Federal?

Under Florida’s law, a case may be brought in the county where the property is located or in a county where an important act in the alleged scheme took place. Federal cases from the Tampa Bay area are generally prosecuted in the Middle District of Florida. Because the same loan file can lead to state charges, federal charges, or both, it helps to talk with Attorney Ron Frey early. Learn more on the Federal Offenses page.

How Mortgage Fraud Investigations Often Start

Many cases begin with a review of loan files, bank records, or closing documents, and a person may first hear about an investigation through a subpoena, a target letter, or a visit from agents. If a federal agency has contacted you or a friend or family member, see Investigated by a Federal Agency? and call Attorney Ron Frey right away. Every situation is different, so there are no one-size-fits-all rules for what to do next.

A Financial Background for Financial Cases

Mortgage fraud cases often turn on loan applications, income and asset records, appraisals, settlement statements, and money trails. Attorney Ron Frey earned a Bachelor of Science in Business Administration, with a major in finance, and a Bachelor of Science in Economics from John Carroll University, which gives him a solid foundation for reading the financial records at the center of these cases. See the White Collar and Financial Crimes page for the other financial cases Attorney Ron Frey handles.

Talk With Attorney Ron Frey

Many people think burglary means breaking into a home at night, but burglary charges in Florida are much broader. Entering or remaining in a home, building, or vehicle with the intent to commit an offense inside can lead to a burglary charge, and the potential penalties can be serious, especially when the structure is a home.

Here is a general overview of how burglary cases are handled under Florida law, and the limited situations where related conduct becomes federal, at the time of this writing. Every case is different and laws change, so for answers about a specific situation, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

In Florida, burglary is generally charged under Section 810.02, Florida Statutes (Burglary). Burglary is rarely charged federally, but related conduct can be charged under federal statutes such as 18 U.S.C. § 2113 (Bank robbery and incidental crimes). Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

How Florida Generally Treats Burglary

Under Florida law, burglary generally involves entering a dwelling, structure, or conveyance with the intent to commit an offense inside, or remaining inside under certain circumstances after permission ends. A conveyance can include a car, so many vehicle break-ins are charged as burglary.

The seriousness of the charge generally depends on what was entered, whether anyone was inside, whether the person was armed, and whether anyone was assaulted or battered. Burglary of a home is generally treated more seriously than burglary of a business or vehicle. Pretrial diversion programs also exist, and some people may qualify. Our posts on Hillsborough pretrial intervention and Pinellas pretrial intervention explain more.

When Burglary Becomes a Federal Case

Most burglary cases stay in state court. Related conduct can become federal when it involves a federally insured bank, federal property, a post office, or stolen goods moved across state lines.

When federal charges are brought, they are often investigated by the FBI or other federal agencies working with local police. In the Tampa Bay area, those rare federal cases go to the Middle District of Florida. Our federal offenses page explains what that process generally looks like.

How Burglary Investigations Often Start

Burglary investigations often begin with a 911 call, a home or business security camera, fingerprints or DNA, or recovered property at a pawn shop. Some people first learn they are suspects from a detective call or officers arriving with a search warrant to look for property.

Attorney Ron Frey generally advises that anyone contacted by police about a burglary speak with an attorney before making any statements, because intent at the time of entry is often the key issue.

What a Burglary Defense Generally Looks At

Every case turns on its own facts. In general, a defense may look at whether the person had permission to be there, whether there was intent to commit an offense at the time of entry, whether the identification is reliable, and how fingerprint, DNA, video, and property-recovery evidence was handled. Being inside a place, or having property later, does not by itself prove burglary.

Attorney Ron Frey brings over two decades of criminal defense experience to burglary cases in Hillsborough and Pinellas courts, looking closely at how the evidence connects, or fails to connect, a person to the entry.

In many burglary cases, the key question is what a person intended at the moment they entered, and that is rarely as clear as a police report suggests.
Robbery charges in Florida are treated as serious violent felonies, even when no one is hurt and nothing of great value is taken. The charge can range from robbery by sudden snatching to armed robbery or home-invasion robbery, and some cases, such as bank robberies, are prosecuted federally.

This post explains, in general terms, how robbery cases are handled under Florida law and in the federal system at the time of this writing. Every case is different and laws change, so for answers about a specific situation, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

In Florida, robbery is generally charged under Section 812.13, Florida Statutes (Robbery). In the federal system, these cases are typically charged under 18 U.S.C. § 2113 (Bank robbery and incidental crimes) or 18 U.S.C. § 1951 (Interference with commerce by threats or violence, often called the Hobbs Act). Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

How Florida Generally Treats Robbery

Under Florida law, robbery generally involves taking money or property from another person by force, violence, assault, or putting the person in fear, with the intent to deprive them of it. The force or fear is what separates robbery from theft.

Under the robbery statute, the seriousness of the charge generally depends on whether the person carried a firearm, a deadly weapon, or another weapon, or no weapon at all. Separate statutes cover robbery by sudden snatching, carjacking, and home-invasion robbery. Armed robbery and home-invasion robbery can carry very serious felony penalties, and certain firearm allegations can bring mandatory minimum sentences.

When Robbery Becomes a Federal Case

Robbery becomes a federal case most often when a federally insured bank or credit union is involved, when a business engaged in interstate commerce is targeted, or in certain carjacking cases. Federal prosecutors often add firearm charges, which can carry mandatory consecutive sentences.

Federal robbery cases are often investigated by the FBI, sometimes with local police task forces, and frequently rely on surveillance video, phone records, and cell-site location data. Bank and business robbery cases from the Tampa Bay area are generally brought in the Middle District of Florida. Our federal offenses page has more on what to expect in federal court.

How Robbery Investigations Often Start

Robbery investigations often begin with a 911 call, surveillance video, a photo lineup, or a tip. Some people first learn they are suspects from a detective call asking them to come in, or from officers arriving with an arrest warrant or search warrant.

Attorney Ron Frey generally advises that anyone contacted by investigators about a robbery speak with an attorney before making any statements or participating in a lineup or interview.

What a Robbery Defense Generally Looks At

Every case turns on its own facts. In general, a defense may look at whether the identification is reliable, whether force or fear was actually used, whether a weapon was really involved, whether the person intended to take the property, and how video, phone, and location evidence was collected and interpreted. Eyewitness identifications made under stress are not always accurate.

With over two decades of criminal defense experience in state and federal court, Attorney Ron Frey closely reviews identification procedures and video evidence in robbery cases.

Firearm charges in Florida can come up on their own, such as a possession case, or alongside other charges, where a gun can greatly increase the potential penalties. These cases can be charged in Florida state court, federal court, or both.

This post offers a general overview of how firearm and weapons cases are handled under Florida law and in the federal system, at the time of this writing. Every case is different and laws change, so for answers about a specific situation, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

In Florida, weapons offenses are generally addressed in Chapter 790, Florida Statutes (Weapons and firearms), including Section 790.23 (possession of firearms by convicted felons). In the federal system, these cases are typically charged under 18 U.S.C. § 922 (Unlawful acts), which includes possession by prohibited persons. Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

How Florida Generally Treats Firearm Charges

Firearm charges in Florida can range from possession cases to charges where a gun is alleged to have been involved in another offense. When a firearm is alleged to be part of another crime, the charge and the potential penalties can become much more serious.

Firearm laws in Florida have changed often in recent years and continue to change. Whether any particular conduct is lawful depends on the specific facts and the law at the time, so anyone with questions should speak with an attorney rather than rely on general information online.

When a Firearm Charge Becomes a Federal Case

Firearm cases are frequently prosecuted federally. Federal law generally prohibits certain people, such as those with felony convictions or certain domestic violence convictions, from possessing firearms or ammunition. Federal law also carries mandatory consecutive sentences when a firearm is used or carried in connection with a crime of violence or a drug trafficking crime.

Federal firearm cases are often investigated by the ATF, sometimes working with local police through programs that refer gun cases for federal prosecution. A gun arrest by local police in Tampa Bay can end up in the Middle District of Florida, sometimes after a state case is dropped in favor of a federal one. Our federal offenses page explains how federal cases generally proceed.

How Firearm Investigations Often Start

Firearm cases often begin with a traffic stop, a call for service, a search during another investigation, or a firearm purchase background check. Some people first learn of an investigation from a detective call, a search warrant at their home, or, in federal cases, a target letter.

Attorney Ron Frey generally advises that anyone questioned about a firearm speak with an attorney before making any statements, because statements about who owned or handled a gun are often central to these cases.

What a Firearm Defense Generally Looks At

Every case turns on its own facts. In general, a defense may look at whether the stop and search were lawful, whether the person actually or constructively possessed the firearm, whether the person was in fact prohibited from possessing it, and whether forensic evidence such as DNA or fingerprints supports the allegation. In shared cars and homes, being near a firearm is not the same as possessing it.

Attorney Ron Frey has over two decades of experience defending people in both Florida state court and federal court.

Charged With a Gun Offense in Tampa? Call Attorney Ron Frey.

In firearm cases, details such as who owned the gun, where it was found, and how the search happened can matter a great deal. If you or a family member has been charged with a firearm or weapons offense, or contacted by police or federal agents about a firearm, it’s wise to talk with a lawyer before answering questions.
Prescription drug fraud charges in Florida can involve patients, caregivers, pharmacy staff, and medical professionals. Allegations may include altered or forged prescriptions, seeing multiple doctors for the same medication, or prescribing and dispensing outside legitimate medical practice. These cases can be charged in Florida state court, federal court, or both, and they can also affect professional licenses.

Below is a general explanation of how these cases are handled under Florida law and in the federal system, at the time of this writing. Every case is different and laws change, so for answers about your own situation, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

In Florida, obtaining a controlled substance by fraud or forgery is generally addressed under Section 893.13, Florida Statutes (Prohibited acts; penalties). In the federal system, these cases are typically charged under 21 U.S.C. § 843 (Prohibited acts C), which generally covers obtaining controlled substances by fraud or forgery. Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

How Florida Generally Treats Prescription Drug Fraud

Under Florida law, prescription fraud generally involves obtaining, or trying to obtain, a controlled substance or medicinal drug through deception, such as a forged or altered prescription, a false name, or withholding information from a doctor about other prescriptions. Florida’s prescription drug monitoring program gives investigators a record of prescriptions filled across pharmacies.

How serious the charge is generally depends on the drug involved and the conduct alleged. For licensed professionals, a criminal case can be accompanied by a separate licensing investigation. Pretrial diversion programs also exist, and some people may qualify. Our posts on Hillsborough pretrial intervention and Pinellas pretrial intervention explain more. Cases that involve selling or distributing drugs are covered in our post on drug sale and intent-to-sell charges.

When Prescription Drug Fraud Becomes a Federal Case

Prescription drug cases become federal more often when they involve doctors, pharmacies, clinics, large quantities, or billing to Medicare or other federal programs. Federal law generally treats prescribing or dispensing outside the usual course of professional practice as unlawful distribution.

These cases are often investigated by the DEA’s Diversion Control Division, the FBI, or the Department of Health and Human Services Office of Inspector General. Prescription and pill-clinic cases from the Tampa Bay area are generally prosecuted in the Middle District of Florida, and some involve state charges first. Our federal offenses page covers how federal cases generally proceed.

How Prescription Drug Fraud Investigations Often Start

These investigations often begin with a pharmacist’s report, a prescription monitoring database flag, an insurance or Medicare audit, or a tip from a co-worker. Some people first learn of an investigation from a detective call, a target letter, or a search warrant at a clinic, pharmacy, or home.

Attorney Ron Frey generally advises that anyone contacted by investigators or a licensing board about a prescription matter speak with an attorney before making any statements, since what is said in one setting can be used in another.

What a Prescription Drug Fraud Defense Generally Looks At

Every case turns on its own facts. In general, a defense may look at whether the prescriptions were legitimate, whether the person knew of any forgery or alteration, whether medical records support the treatment, how database records were interpreted, and how the evidence was gathered. Prescription and billing records can be complicated and do not always mean what investigators assume.

Attorney Ron Frey has over two decades of experience defending people in both Florida state court and federal court. He also brings a strong financial background to these cases. He earned a Bachelor of Science in Business Administration, with a major in finance, and a Bachelor of Science in Economics from John Carroll University, which helps him understand the billing and financial records that can sit at the center of prescription and health care fraud cases.

Questioned About a Prescription Matter? Call Attorney Ron Frey.

Prescription cases often involve a criminal investigation and a licensing review at the same time, and the two need to be handled together. If you or a family member has been accused of prescription drug fraud, or contacted by investigators or a licensing board, get legal advice before responding to either. Attorney Ron Frey represents people facing Florida state and federal charges in Tampa, Hillsborough County, Pinellas County, and the Middle District of Florida.
Federal drug conspiracy charges in Florida can reach people who never personally sold or carried drugs. Prosecutors may charge many people in one indictment, alleging that each agreed to be part of a larger plan. These cases are complex, the potential penalties are serious, and the same conduct can sometimes also be charged in Florida state court.

This post gives a general overview of how drug conspiracy cases work in federal court, and how Florida handles similar charges, at the time of this writing. Every case is different and laws change, so to discuss a specific case, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

In the federal system, drug conspiracy is typically charged under 21 U.S.C. § 846 (Attempt and conspiracy). In Florida, conspiracy is generally addressed under Section 777.04, Florida Statutes (Attempts, solicitation, and conspiracy). Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

How Florida Generally Treats Drug Conspiracy

Under Florida law, a conspiracy generally involves an agreement between two or more people to commit a crime, together with the intent that it be carried out. Florida’s trafficking statute separately addresses conspiracy to traffic, which is generally treated as seriously as trafficking itself.

State conspiracy cases often come from local narcotics units and sheriff’s office investigations. Some cases start in state court and later move to federal court, or the reverse.

When Drug Conspiracy Becomes a Federal Case

Federal drug conspiracy is one of the most common charges in federal court. In general, the government must show that an agreement existed and that the person knowingly and voluntarily joined it. Federal drug conspiracy generally does not require proof of an overt act, and a person may be held responsible for drug quantities connected to the conspiracy, which can affect mandatory minimums and sentencing guidelines.

These cases are often built over months or years by agencies such as the DEA, FBI, or Homeland Security Investigations, using wiretaps, phone records, informants, and cooperating co-defendants. Forfeiture of money, vehicles, or property is common. Conspiracy indictments from the Tampa area are generally brought in the Middle District of Florida, often naming many defendants at once. Our federal offenses page has more on how federal cases work.

Florida’s Three Federal Districts

Florida is divided into three federal judicial districts, and where a case is filed affects which courthouse, judges, prosecutors and local procedures apply. The Middle District of Florida covers a large part of the state, with courthouses in Tampa, Orlando, Jacksonville, Fort Myers and Ocala. The Southern District of Florida covers South Florida, with courthouses in Miami, Fort Lauderdale, West Palm Beach, Fort Pierce and Key West. The Northern District of Florida covers the Panhandle and North Central Florida, with courthouses in Tallahassee, Pensacola, Gainesville and Panama City.

A federal drug conspiracy case is generally filed in a district where part of the alleged agreement or conduct took place. Because conspiracies can stretch across counties and state lines, people in one city are sometimes charged in a district far from home. That can affect where a person must appear, where detention hearings are held, and how often a friend or family member can attend court. Each district also has its own local rules and practices.

Attorney Ron Frey is admitted to practice in the Middle and Southern Districts of Florida. For a closer look at cases filed in the Tampa courthouse, see our post on federal drug conspiracy charges in Tampa.

How Drug Conspiracy Investigations Often Start

Many people first learn about a federal drug conspiracy when agents make arrests across several locations on the same morning, or when they receive a target letter or grand jury subpoena. Others get a call from a detective or federal agent, or find agents at the door with a search warrant.

Attorney Ron Frey generally advises that anyone contacted by federal agents speak with an attorney before making any statements. In conspiracy cases, conversations with agents, or with others involved, can later become evidence.

What a Drug Conspiracy Defense Generally Looks At

Every case turns on its own facts. In general, a defense may look at whether the person actually agreed to join the conspiracy or merely knew or associated with people involved, the scope of any agreement, how drug quantity was attributed, the legality of wiretaps and searches, and the reliability and motives of cooperating witnesses. Being present, related to, or friends with someone involved is not the same as joining a conspiracy.

Attorney Ron Frey has been practicing law for over two decades, defending people in both Florida state court and federal court.

Named in a Federal Drug Conspiracy? Call Attorney Ron Frey.

Conspiracy cases are document-heavy and move on the government’s timeline, so the earlier the defense is involved, the more room there is to work. If you or a friend or family member has been charged in a federal drug conspiracy, or received a target letter or subpoena, reach out before speaking with agents. Attorney Ron Frey represents people facing Florida state and federal charges in Tampa, Hillsborough County, Pinellas County, and the Middle District of Florida.
Possession with intent to sell charges in Florida are often based less on an actual sale than on what officers found: the amount, how it was packaged, cash, scales, or messages on a phone. Prosecutors may use these details to argue that drugs were meant for sale rather than personal use. Depending on the facts, these cases can be charged in Florida state court, federal court, or both.

This post walks through how sale and intent-to-sell cases are generally handled in Florida and federal court, at the time of this writing. Every case is different and laws change, so for advice about a specific situation, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

In Florida, selling, delivering, or possessing with intent to sell a controlled substance is generally charged under Section 893.13, Florida Statutes (Prohibited acts; penalties). In the federal system, these cases are typically charged under 21 U.S.C. § 841 (Prohibited acts A). Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

How Florida Generally Treats Drug Sale and Intent to Sell

Under Florida law, a sale or delivery charge generally involves transferring, or agreeing to transfer, a controlled substance to another person. Possession with intent to sell generally involves possessing a substance while intending to sell or deliver it, which prosecutors often try to show through circumstantial evidence.

The seriousness of the charge generally depends on the type of substance and the location. Florida law generally increases penalties when the alleged sale takes place near certain places, such as schools, child care facilities, parks, churches, or public housing. When the weight crosses certain thresholds, the case may instead be charged as trafficking.

When a Drug Sale Case Becomes a Federal Case

Distribution cases become federal more often when there are larger quantities, multiple people, controlled buys run by federal agents, or activity across state lines. Federal law also treats distribution near schools and colleges more seriously.

Federal distribution cases are often investigated by the DEA, FBI, or task forces that include local officers, and they can carry significant potential penalties, including mandatory minimums in some cases. Sale cases arising in the Tampa Bay area are generally filed in the Middle District of Florida, and state and federal prosecutors may both have an interest in the same facts. See our federal offenses page for more.

How Drug Sale Investigations Often Start

These investigations often begin with a confidential informant, an undercover officer, a controlled buy, or a review of text messages and social media. Some people first learn of an investigation from a detective call, a search warrant at their home, or an arrest weeks after an alleged sale.

Attorney Ron Frey generally advises that anyone contacted by investigators about a drug sale speak with an attorney before making any statements, because messages and conversations can later become evidence.

What a Drug Sale Defense Generally Looks At

Every case turns on its own facts. In general, a defense may look at whether the evidence actually shows intent to sell rather than personal use, how reliable any informant is, whether recordings and messages are complete and accurately attributed, whether the search was lawful, and whether entrapment issues are present. Cash, scales, or baggies do not always mean what investigators assume.

With over two decades of experience in Florida state and federal courts, Attorney Ron Frey knows how often an intent-to-sell case depends on how the evidence is interpreted.

The difference between personal use and intent to sell is often a matter of interpretation, and that is where a careful defense starts.
Drug possession charges in Florida often start with an ordinary moment: a traffic stop, a search of a home or car, or an investigation that began with someone else. For many people it is their first time in the criminal justice system, and for families it can be hard to know what happens next. Depending on the facts, these cases can be charged in Florida state court, federal court, or both.

Here is a plain-language look at how possession cases are generally handled in Florida and, less often, in federal court, at the time of this writing. Every case is different and laws change, so to talk about your own situation, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

In Florida, drug possession is generally charged under Section 893.13, Florida Statutes (Prohibited acts; penalties). In the federal system, simple possession is typically addressed under 21 U.S.C. § 844 (Penalties for simple possession). Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

How Florida Generally Treats Drug Possession

Under Florida law, possession generally means knowing that a controlled substance is present and having the ability to control it. That can mean actual possession, such as drugs in a pocket, or constructive possession, such as drugs found in a shared car or home. Constructive possession cases often turn on who knew the substance was there and who had control over the place it was found.

How serious a possession charge is generally depends on the type of substance, its schedule, and the amount. Some small-amount cases are misdemeanors, while many possession charges are felonies. A possession case can also bring consequences beyond the courtroom, such as effects on a driver license, employment, professional licenses, or immigration status. Pretrial diversion programs also exist, and some people may qualify. Our posts on Hillsborough pretrial intervention and Pinellas pretrial intervention explain more.

When Drug Possession Becomes a Federal Case

Most simple possession cases are handled in state court. Possession can become a federal case when it happens on federal property, such as a military base, national park, or federal building, at an airport or port of entry, or when it is connected to a larger federal drug investigation.

When a possession case does go federal, it is generally prosecuted by the U.S. Attorney’s Office, and for the Tampa area that means the Middle District of Florida. A person can sometimes face charges in both systems for related conduct. You can read more on our federal offenses page.

How Drug Possession Investigations Often Start

Many possession cases begin with a traffic stop, a consent search, a call for service, or a probation check. Others grow out of a larger investigation, where officers execute a search warrant at a home or business and charge everyone present. Sometimes the first sign of trouble is a call from a detective asking to “clear something up.”

Attorney Ron Frey generally advises that anyone contacted by police about a drug matter speak with an attorney before making any statements or agreeing to a search. Statements made in the moment are often a central part of the case.

What a Drug Possession Defense Generally Looks At

Every case turns on its own facts. In general, a defense may look at whether the stop and search were lawful under the Fourth Amendment, whether the person actually knew about the substance and had control over it, whether the substance was properly tested and identified, and how the evidence was handled from the scene to the lab. In shared spaces, simply being near drugs is not the same as possessing them.

Drawing on over two decades of criminal defense experience in state and federal court, Attorney Ron Frey looks closely at how the search happened and how the evidence was handled.

Arrested for Drug Possession in Tampa or St. Pete? Call Attorney Ron Frey.

A possession arrest is stressful, especially for someone who has never been in trouble before, but it is the beginning of a process, not the end of one. If you or a family member has been arrested or contacted by police about a drug matter, a conversation with a lawyer is a good first step. Attorney Ron Frey represents people facing Florida state and federal charges in Tampa, Hillsborough County, Pinellas County, and the Middle District of Florida.
Drug trafficking charges in Florida do not always mean what people picture. A trafficking charge is often based mainly on the weight of the substance, so a person can be charged with trafficking without any evidence of a sale. These are among the most serious drug charges in Florida, and they can be brought in state court, federal court, or both.

Below is a general overview of how trafficking cases are handled under Florida law and in the federal system, at the time of this writing. Every case is different and laws change, so for answers about a specific situation, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

In Florida, drug trafficking is generally charged under Section 893.135, Florida Statutes (Trafficking; mandatory sentences). In the federal system, these cases are typically charged under 21 U.S.C. § 841 (Prohibited acts A) and 21 U.S.C. § 846 (Attempt and conspiracy). Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

How Florida Generally Treats Drug Trafficking

Under Florida law, trafficking generally involves knowingly selling, purchasing, manufacturing, delivering, bringing into Florida, or possessing a controlled substance above certain weight thresholds. The thresholds differ by substance, such as cannabis, cocaine, oxycodone and other opioids, methamphetamine, and others. Fentanyl has its own, much lower threshold, measured in grams, and the Legislature has revised the fentanyl provisions more than once in recent years.

Florida’s trafficking statute generally carries mandatory minimum prison sentences and mandatory fines that increase as the weight increases. Because the weight of a mixture can count, not just the pure drug, the way the substance was weighed and tested can matter a great deal. The statute also addresses conspiracy to traffic, which can be charged even when no drugs change hands.

When Drug Trafficking Becomes a Federal Case

Federal prosecutors frequently bring drug trafficking cases, generally when the investigation involves larger quantities, multiple people, interstate or international movement, or federal agencies. Federal drug laws also carry mandatory minimum sentences tied to drug type and quantity, and federal sentencing follows its own guidelines.

These cases are often built through long investigations by agencies such as the DEA, FBI, or Homeland Security Investigations, sometimes using wiretaps, informants, controlled buys, or cooperating witnesses. Property connected to the case may also be subject to forfeiture. In Tampa, federal cases are handled in the Middle District of Florida. The same conduct can sometimes be charged in state court, federal court, or both. Our page on federal offenses explains more.

How Drug Trafficking Investigations Often Start

Trafficking investigations often begin with an informant, a controlled buy, a package interception, a traffic stop on an interstate, or a wiretap in a larger case. Some people first learn they are involved when agents arrive with a search warrant, when they receive a target letter, or when a detective calls asking questions.

Attorney Ron Frey generally advises that anyone contacted by investigators in a trafficking matter speak with an attorney before making any statements. Early decisions in these cases can affect the charges, the potential sentence, and how the case is resolved.

What a Drug Trafficking Defense Generally Looks At

Every case turns on its own facts. In general, a defense may look at whether the search and seizure were lawful, whether the person knew about the substance and had control over it, whether the weight was measured and calculated correctly, whether the lab testing was reliable, and how informants or cooperating witnesses were used. Weight is often the difference between a trafficking charge and a lesser one.

Attorney Ron Frey has over two decades of experience defending people in both Florida state court and federal court.

In South Florida, federal court is busy. The Southern District of Florida handles a heavy volume of cases, and a person arrested on federal charges in Miami, Fort Lauderdale, or West Palm Beach will usually appear before a magistrate judge quickly, often alongside many others in the same session. That first hearing, the initial appearance, sets the course for what comes next, and families are often trying to follow it from far away.

This post explains, in general terms and at the time of this writing, what an initial appearance in the Southern District of Florida usually involves, whether the case is in Miami, Fort Lauderdale, West Palm Beach, or another division. Local practices, schedules, and procedures can change, and every case is different. To find out what applies to a specific situation, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

The initial appearance is generally governed by Rule 5 of the Federal Rules of Criminal Procedure (Initial Appearance). Release and detention are generally addressed by the Bail Reform Act, 18 U.S.C. § 3142 (release or detention of a defendant pending trial). Each district also has its own local rules. Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

Where Federal Cases Are Heard in the Southern District

The U.S. District Court for the Southern District of Florida covers South Florida, from the Treasure Coast through the Florida Keys. It has courthouses in Miami, Fort Lauderdale, West Palm Beach, Fort Pierce, and Key West. Miami is the busiest, and the district handles a large volume of fraud, health care fraud, drug, immigration-related, and financial cases. Where a case is heard generally depends on where the alleged offense happened and where the charges were filed. A person arrested in South Florida will generally have the initial appearance before a U.S. Magistrate Judge at one of these courthouses.

How a Person Gets to the Initial Appearance

In South Florida, federal cases often begin with an investigation that has been going on for months. A person may be arrested on a warrant after a criminal complaint or an indictment, arrested at the scene, or, when a lawyer gets involved early, allowed to self-surrender to the U.S. Marshals at a set time. Some people first hear about a case through a federal target letter, a grand jury subpoena, or a search warrant executed at a home or business.

If federal agents reach out, Attorney Ron Frey generally advises using the right to remain silent and speaking with an attorney before answering any questions. What a person says in those first hours can be used later.

Once arrested, the person is generally booked by the U.S. Marshals Service and held until court. In South Florida, federal detainees are often housed in federal or contract facilities in the area, which can make it hard for a friend or family member to find them at first.

The Pretrial Services Interview

Before the person sees a judge, a U.S. Pretrial Services officer for the Southern District will usually try to speak with them. Pretrial Services is part of the court, not the prosecution. The officer gathers basic background, such as home, work, family, health, and any prior record, and may call relatives to confirm details. That information goes into a report and a release recommendation for the magistrate judge.

Answers should be truthful, but the facts of the case should not be discussed. An attorney can help make sure the judge hears the person’s strongest community ties, such as steady work, a stable residence, and family support.

What Happens at the Initial Appearance

Under Rule 5, a person arrested on federal charges must generally be brought before a U.S. Magistrate Judge without unnecessary delay. In the Southern District, that usually means the courthouse for the area where the arrest happened or the case was filed, often the same day or the next business day. Because the district is so busy, many people may appear in a single session, and each individual hearing can move quickly. In general, the magistrate judge will:

Explain the charges and, in general terms, the possible penalties

Advise the person of the right to remain silent and the right to a lawyer

Determine whether the person qualifies for a court-appointed lawyer

Explain the right to a preliminary hearing if the case started with a complaint

Remind the government of its duty to turn over favorable evidence

Address release or detention, or schedule a detention hearing

No guilty or not guilty plea is generally entered at this first hearing. The arraignment, where a plea is entered, usually comes later.

Choosing a Lawyer

A person who cannot afford counsel may be appointed the Federal Public Defender or a Criminal Justice Act panel attorney after the court reviews a financial affidavit. Many families instead decide to hire a private attorney. When retained, Attorney Ron Frey can appear at the initial appearance and any detention hearing and speak on the person’s behalf. He has over two decades of experience defending people in Florida state and federal courts.

Release or Detention in South Florida

There is generally no bond schedule in federal court. The magistrate judge decides whether any set of conditions can reasonably assure that the person will return to court and that the community will be safe. When the government seeks detention in an eligible case, the court holds a detention hearing, either right away or within a few days, and the person usually remains in custody until then. If release is granted, the Southern District’s Pretrial Services office generally supervises conditions such as check-ins, travel restrictions, or electronic monitoring.

For more on detention hearings, presumption cases, and release conditions, see our post on federal pretrial detention and release in Florida.

Arrests in Another District

A person arrested in South Florida may be wanted on charges from somewhere else, such as the Middle District or another state. In that case, there is generally a first appearance in the Southern District, where the judge addresses identity, the charging papers, release or detention, and transfer. Whether to address detention in South Florida or wait for the charging district can be an important decision. The opposite also happens: a person arrested in Tampa on a Miami case will generally appear first in the Middle District before being moved to the Southern District. Call Attorney Ron Frey to talk through the options.

What Comes Next

After the initial appearance, a case generally proceeds to a preliminary hearing or indictment, then arraignment, discovery, motions, and finally a plea or trial. Our guide on what happens after a federal arrest in Florida covers each stage. South Florida sees many financial cases, and our posts on fraud and bribery, embezzlement, and money laundering may also help.

Frequently Asked Questions

Can a friend or family member be released the same day? It’s possible. When the government does not ask for detention, the magistrate judge may set release conditions at the first hearing. When it does, the person is generally held until the detention hearing.

What happens at a detention hearing? The judge decides whether the person can be released while the case is pending and, if so, under what conditions. Solid information about family, employment, and a place to stay can make a meaningful difference.

Should family members attend court? It can help. Relatives may be able to act as co-signers or third-party custodians, and their presence shows the court the person’s community ties. Talk with Attorney Ron Frey before the hearing about what role family should play.

What does Pretrial Services do? It is a court office that interviews people after arrest, checks their background, makes a release recommendation, and supervises those released before trial.

What if the arrest happened outside South Florida? The person generally first appears in the district where they were arrested, where the court handles identity, release or detention, and transfer to the district where the case is pending.

Is a plea entered at the initial appearance? Generally not. A plea is usually entered later, at the arraignment.

How can I find out when and where the hearing will be? Court schedules shift, and hearings may be set on short notice. Attorney Ron Frey can help find out where the person is being held and when they are expected in court.

Call Attorney Ron Frey

If a friend or family member was arrested on federal charges, federal pretrial detention in Florida is often the first and most important question: will they be released while the case goes on? Federal court works very differently from state court. There is generally no bond schedule, no posting bond at the jail, and in many cases no bondsman. Instead, a federal magistrate judge decides release under a federal law called the Bail Reform Act, often soon after the arrest.

This post focuses on federal pretrial detention in Florida and how release decisions are generally made in the Middle District and the Southern District, at the time of this writing. Every case is different and laws change, so for answers about a specific situation, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

In the federal system, pretrial release and detention are generally governed by the Bail Reform Act of 1984, including 18 U.S.C. § 3142 (Release or detention of a defendant pending trial), and by Rule 46, Federal Rules of Criminal Procedure (Release from Custody). Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

How Federal Bond Is Different From State Bond

In Florida state court, many families are used to a bond amount, a jail window and a bondsman. Federal court generally starts from a different question: are there conditions that will reasonably assure the person comes to court and the safety of others? The law generally favors release on the least restrictive conditions that will work, and it says a judge may not impose a financial condition that results in detention just because the person can’t afford it.

Federal release decisions are usually made by a U.S. Magistrate Judge, often at or soon after the initial appearance. Our step-by-step guide to what happens after a federal arrest walks through the whole process. This post focuses on the release and detention part.

The Pretrial Services Interview

Before the first hearing, a U.S. Pretrial Services officer generally interviews the person about family, residence, work, finances, health and history, and checks the information. Pretrial Services then gives the judge a report, often with a recommendation on release or detention and proposed conditions. The interview generally isn’t about the facts of the case, and the person should not discuss the charges. If Attorney Ron Frey is retained early, he can help make sure accurate information about the person’s ties and stability is available.

When the Government Asks for Detention

The government can generally ask the court to hold a person without release only in certain kinds of cases, such as many violent, drug, firearm, and child-related offenses, or cases with a serious risk of flight or of obstructing justice.

When the government moves for detention, the hearing is generally held at the initial appearance, though either side can usually ask for a short delay to prepare, and the person is generally held in the meantime.

The Detention Hearing

At the detention hearing, the person has the right to an attorney, to testify, to present witnesses and information, and to cross-examine witnesses the government calls. The rules of evidence generally don’t apply, so proffers and reports are common. To detain someone as a danger, the government generally must show by clear and convincing evidence that no conditions will reasonably assure the safety of others. To detain someone as a flight risk, courts generally require a showing by a preponderance of the evidence.

In general, the judge considers the nature of the charge, the weight of the evidence, the person’s history and ties to the community, whether the person was already on supervision, and any danger release would pose.

Preparation matters. A detention hearing can shape the entire case, because a person who is released can work with their attorney, keep their job and support their family while the case moves forward. Families can often help by being available as potential third-party custodians or sureties and by providing information about stable housing and work.

Presumption Cases

In some cases, the law presumes that no conditions will be enough. In general, this presumption applies to certain serious drug, firearm, and child-related offenses, and some cases involving prior convictions. In a presumption case, the defense generally must come forward with some evidence that the person isn’t a flight risk or danger, but the government still carries the ultimate burden. Presumption cases are not automatic detention, and many people in these cases are released on conditions, but each case is different.

Types of Federal Release and Common Conditions

When a person is released, it is generally on one of these:

Personal recognizance or an unsecured appearance bond, a promise to appear, with money owed only if the person doesn’t

Conditions of release set by the court

a bond co-signed by family members or secured by property or cash

Common conditions include reporting to Pretrial Services, surrendering a passport, travel limits (often to the district), living at an approved address, a third-party custodian, location monitoring, drug testing or treatment, no alcohol, mental health treatment, no firearms, keeping or seeking a job, and no contact with alleged victims, witnesses or co-defendants. Pretrial Services generally supervises these conditions until the case ends. In internet and computer crime cases, courts generally also consider limits on internet and device use; see Federal Pretrial Release and Detention in Internet Crime Cases, Explained.

What Happens If a Condition Is Violated?

Generally under federal law, a person who violates a release condition can face revocation of release, an order of detention, and prosecution for contempt. A new crime while on release can also bring added penalties. If a condition is causing a problem, such as a job that requires travel, the right step is to ask the court through an attorney, not to work around it.

Can a Detention or Release Order Be Reviewed or Changed?

Yes, in general. Generally, if a magistrate judge orders detention or sets conditions, the defense may file a motion with the district judge to revoke or amend the order, and the government can seek review of a release order. A detention hearing can also be reopened when there is new and material information that wasn’t known at the first hearing. Conditions can be modified when circumstances change. Appeals from the district court’s decision generally go to the U.S. Court of Appeals for the Eleventh Circuit.

Middle District and Southern District of Florida

Florida has three federal districts. Tampa, St. Petersburg and Clearwater are in the Middle District of Florida, which also includes Orlando, Jacksonville, Fort Myers and Ocala. Miami, Fort Lauderdale and West Palm Beach are in the Southern District of Florida. Both districts apply the same Bail Reform Act and have their own Pretrial Services offices and local rules. The details of scheduling and supervision can vary by courthouse. If a person is arrested in one district on a case pending in another, release questions can come up in both. Our initial appearance guides for the Middle District and the Southern District explain more.

Frequently Asked Questions

Is there a bond schedule in federal court?

Generally no. A federal judge decides release individually under the Bail Reform Act.

Can we use a bail bondsman in federal court?

Generally, federal bonds are not posted through a commercial bondsman the way state bonds often are. Federal bonds are usually personal recognizance, unsecured, co-signed by family, or secured by property or cash.

What is a detention hearing?

It’s a hearing where the judge decides whether the person will be released on conditions or held until trial. It’s generally held at or soon after the initial appearance.

What is a presumption case?

A case where the law presumes no conditions will work, such as many serious drug and certain firearm cases. The defense can rebut the presumption with evidence.

Can family members help?

Often, yes. Family members may serve as co-signers, sureties or third-party custodians, and can provide information about housing and work. An attorney can explain what may be needed.

If the judge orders detention, is that final?

Not necessarily. The defense can seek review by the district judge, and a hearing may be reopened with new and material information.

What does Pretrial Services do?

Pretrial Services interviews the person, reports to the court, and supervises people released on conditions.

After an arrest in St. Petersburg, Clearwater, Largo, or elsewhere in Pinellas County, families usually want to know two things: when can the person come home, and what will it take? Bond in Pinellas County follows its own local schedule and procedures, and understanding them can help your family make calm, informed decisions.

This post explains how bond and pretrial release generally work in Pinellas County at the time of this writing. Local procedures change and every case is different, so for answers about a specific situation, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

In Florida, bond and pretrial release are generally governed by Article I, Section 14 of the Florida Constitution (Pretrial release and detention), Chapter 903, Florida Statutes (Bail), and Rule 3.131 (Pretrial Release), Florida Rules of Criminal Procedure. Pinellas County is part of the Sixth Judicial Circuit, which also issues local administrative orders on bond. Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

One Jail for the Whole County

Whether the arrest was made by the Pinellas County Sheriff’s Office or by a city department such as St. Petersburg or Clearwater police, people arrested in Pinellas County are generally booked into the Pinellas County Jail in Clearwater. The Sheriff’s Office online inmate search generally shows the charges and any bond that has been set.

The Pinellas Bond Schedule and “First Appearance Required”

Before a person sees a judge, the jail uses the bond schedule set by the Sixth Circuit, which builds on the statewide schedule adopted by the Florida Supreme Court. Many charges, though, are listed as “first appearance required,” meaning no bond can be posted until a judge decides. In general, that includes many felonies and domestic violence charges, as well as a person arrested while already on pretrial release.

First Appearance

A person who isn’t released on the schedule generally sees a judge at first appearance within 24 hours of arrest, usually by video from the jail. The judge reviews probable cause and decides bond and conditions, considering the charge, the evidence, the person’s record and history of coming to court, community ties, and any danger to others. The schedule is not binding on the judge, so the result can be higher, lower, or release with no money at all.

If Attorney Ron Frey is retained, he can appear at first appearance and speak on the person’s behalf about release and conditions, such as steady work, family responsibilities, and long ties to the Tampa Bay area.

Cash, Bondsman, and Getting Money Back

When a monetary bond is set, it can generally be posted in full as cash or through a licensed bail bond agent, who charges a nonrefundable premium. A cash bond is generally returned at the end of the case, but the clerk generally deducts unpaid fines, court costs, and fees first. Our overview of bond and bail in Florida covers these choices in more detail.

No-Contact Conditions in Domestic Cases

A domestic battery arrest in Pinellas County usually means release with a no-contact condition. That generally rules out any contact, direct or through other people, and requires staying away from the alleged victim’s home and workplace, which can keep the person out of a shared home. The alleged victim can’t lift the condition; only the court can. Attorney Ron Frey has handled many cases where he obtained no-violent-contact orders and other changes to no-contact conditions, though every case is different. Our Pinellas County domestic violence page explains more.

Changing Bond or Conditions

If the bond is more than the family can post, or a condition makes it hard to work or care for children, an attorney can file a motion to modify bond and request a hearing. The court can reconsider the amount and adjust conditions when there’s good reason. Until a judge changes a condition, it’s important to follow it exactly, because a material violation or a new arrest can lead to revocation of release. Charged with an internet or computer crime? Our page on bond and pretrial detention in Florida internet crime cases explains how bond generally works in those cases.

Pinellas Bond FAQ

My family member was arrested in St. Pete. Where will they be held?

People arrested anywhere in Pinellas County are generally booked into the county jail in Clearwater.

Do we have to use a bondsman?

No. A bond can be posted in full as cash, or through a licensed bondsman for a nonrefundable premium.

What happens after release?

The case generally moves to arraignment and then to pretrial dates. Diversion programs exist in Pinellas County, and some people may qualify.

Arrested in Pinellas County? Call Attorney Ron Frey.

When a friend or family member is arrested in Tampa, Brandon, Plant City, or anywhere else in Hillsborough County, the questions about bond come fast. Where are they? Can they come home tonight? How much will it cost? Do we need a bondsman? Bond in Hillsborough County follows a set path, and knowing the steps can help your family make calm, informed decisions.

This post walks through how bond generally works in Hillsborough County at the time of this writing.

In Hillsborough County, the Thirteenth Judicial Circuit also issues local administrative orders on bond. Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

Step 1: Find Out Where the Person Is Being Held

Hillsborough County has more than one jail, including the Orient Road Jail and the Falkenburg Road Jail. The Hillsborough County Sheriff’s Office online inmate search generally shows where a person is held, the charges, and any bond that has been set. Write down the booking number and every charge listed. That information helps an attorney give you useful guidance right away.

Step 2: Find Out Whether a Bond Can Be Posted Before First Appearance

Before first appearance, the jail generally uses a statewide bond schedule, which the Thirteenth Circuit adopts locally. But many arrests, including many felonies and domestic violence charges, now require the person to see a judge before any release. If the arrest was on a warrant, the warrant itself may list a bond amount, or no bond, set by the judge who signed it.

Step 3: First Appearance in Tampa

If no scheduled bond is available, the person generally sees a judge at first appearance within 24 hours of arrest. The person usually appears by video from the jail. The judge reviews probable cause and then decides bond and conditions of release, and the schedule does not bind the judge at this hearing.

If Attorney Ron Frey is retained, he can appear at first appearance and speak on the person’s behalf about release and conditions. Families can help by quickly gathering a few facts: the person’s employer, a stable address, how long they’ve lived in Hillsborough County, and who depends on them at home.

Step 4: Decide How to Post Bond

If a monetary bond is set, it can generally be posted in full as a cash bond, or through a licensed bail bond agent, who charges a nonrefundable premium. Before signing with a bondsman, read the agreement carefully, especially what you’re promising as a co-signer. Our overview of bond and bail in Florida explains cash bonds, surety bonds, and getting money back in more detail.

No-Contact Conditions in Domestic Cases

In domestic battery cases, release almost always comes with a no-contact condition. “No contact” generally means no calls, texts, social media, or messages passed through others, and staying away from the alleged victim’s home and workplace, even if the home is shared. That can mean the person can’t go home.

Only the court can change a no-contact condition. The alleged victim’s wishes don’t change it on their own. Attorney Ron Frey has handled many cases where he obtained no-violent-contact orders and other modifications to no-contact conditions, but every case is different. Our Hillsborough County domestic violence page explains more.

When Bond Is Too High or a Condition Isn’t Working

An attorney can file a motion to modify bond and ask the assigned judge for a hearing. The court can reconsider a monetary bond the person can’t afford, and can adjust conditions such as no contact, GPS, or curfew when there’s a good reason, such as work, children, or housing. In the most serious cases, the State may seek to hold a person without bond, and the defense can challenge that at a hearing. For bond issues that generally come up in internet crime cases, see Bond and Pretrial Detention in Florida Internet Crime Cases, Explained.

Following every condition matters. Generally under Florida law, a court can revoke release if it finds probable cause of a new crime or a material violation of a condition. If any condition is unclear, ask an attorney before acting on a guess.

Hillsborough Bond FAQ

The inmate search says “no bond.” What does that mean?

Often it means the person must see a judge at first appearance before any bond is set. It doesn’t necessarily mean the person will be held until trial.

Can a lawyer speak for my family member at first appearance?

Yes. If Attorney Ron Frey is retained, he can appear and speak on the person’s behalf about release and conditions.

The alleged victim wants them home. Can they come back?

Not while a no-contact condition is in place. Only the court can modify it, and an attorney can ask.

What happens after release?

The case generally moves to arraignment and then to disposition or pretrial dates. Diversion programs exist in Hillsborough County, and some people may qualify.

When a friend or family member is arrested, the first questions about bond and bail in Florida usually come fast: How much will bond be? Can they get out tonight? Do we need a bondsman? Will we get the money back? It’s a stressful time, and the bond process can feel confusing. The good news is that it generally follows a set of rules, and knowing them can help you make calm, smart decisions in the first hours and days.

This post explains how bond and pretrial release generally work under Florida law, at the time of this writing. Every case is different and the laws in this area changed recently, so for answers about a specific situation, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

In Florida, the right to pretrial release generally comes from Article I, Section 14 of the Florida Constitution (Pretrial release and detention). Bail is generally governed by Chapter 903, Florida Statutes (Bail), and Section 907.041, Florida Statutes (Pretrial detention and release), with court procedures in Rule 3.131 (Pretrial Release), Florida Rules of Criminal Procedure. Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

Can Someone Bond Out Before First Appearance?

Sometimes. Under a recent change in Florida law, the Florida Supreme Court adopts a uniform statewide bond schedule each year. That schedule is used by the jail or law enforcement when a person is allowed to post bond before seeing a judge. Each judicial circuit may add conditions or raise amounts, but generally may not go lower without the Supreme Court’s approval.

The same law lists many situations where a person generally cannot be released before first appearance, including many serious felonies, domestic violence offenses, and cases where the person was already on release, probation, or community control. In those cases, the person waits for a judge at first appearance, which generally happens within 24 hours of arrest. Our posts on first appearance in Hillsborough County and Pinellas County explain that hearing.

If the person qualifies for a scheduled bond, it can often be posted at the jail. If not, the first appearance hearing is where bond is decided.

How Much Will Bond Be?

There is no single answer. The bond schedule only sets amounts for release before first appearance, and it does not bind the judge. At first appearance, the judge must make an individualized decision. Each charge generally carries its own separate bond, so a person arrested on several charges may have several bond amounts that add up.

The judge can set a higher amount, a lower amount, release the person on their own recognizance (ROR) with no money at all, add nonmonetary conditions, or in certain cases hold the person without bond while the State seeks pretrial detention.

What the Judge Looks At

Generally under Florida law, the purpose of bail is to make sure the person comes back to court and to protect the community. In general, the judge considers things like:

the nature of the charge and the evidence

ties to the community, such as family, work, and how long the person has lived here

prior record and any history of missing court

whether the person was already on release, probation or community control

any danger release may pose to the community

This is where having an attorney matters. If Attorney Ron Frey is retained, he can appear at first appearance and speak on the person’s behalf about release and conditions, presenting the person’s ties to the community, work, family responsibilities, and anything else that helps the court see the whole person. At first appearance, the person typically appears by video from the jail, while the attorney is in the courtroom with the judge and the prosecutor.

Cash Bond vs. Surety Bond (Bondsman)

Once a monetary bond is set, there are generally two ways to post it:

Cash bond: The full amount is paid to the jail or clerk. Florida law does not allow a different amount for cash than for a surety bond.

Surety bond through a bail bondsman: A licensed bail bond agent posts the full bond and charges a nonrefundable premium, which in Florida is often around 10% of the bond amount, generally with a minimum. The bondsman may also require collateral or a co-signer, called an indemnitor, who promises to cover the bond if the person doesn’t show up.

Which option makes sense depends on the amount, the family’s finances, and how long the case may last.

ROR and Pretrial Release Programs

Not every release requires money. A judge may release a person on their own recognizance, meaning a written promise to appear. Judges may also order supervised release through a county pretrial services program, where the person reports regularly and follows conditions. For certain serious charges, release without money may generally not be available at first appearance.

Common Conditions of Release

Every person released before trial must, at minimum, stay out of trouble and follow every condition the court sets. Depending on the case, conditions may include:

No contact with the alleged victim or named people. “No contact” is generally read broadly, covering calls, texts, social media, messages through friends, and staying away from the person’s home and workplace, even if the home is shared.

GPS or other electronic monitoring

alcohol monitoring, drug testing, or no alcohol

curfew or travel limits

surrendering firearms

regular reporting to pretrial services

keeping a job or going to school

Read conditions carefully and follow them exactly. If a condition is unclear, ask an attorney before acting on a guess. In internet and computer crime cases, conditions such as limits on internet or device use are common; our page on bond and pretrial detention in Florida internet crime cases explains more.

What Happens If a Condition Is Violated?

Generally under Florida law, the court can revoke release and order the person held if it finds probable cause that the person committed a new crime while out, or violated any other condition in a material way. A new arrest while on pretrial release also generally means no release before first appearance on the new charge. Some violations, such as violating a no-contact condition in certain cases, can also be charged as a separate crime. Our domestic violence page explains how no-contact conditions generally work in domestic battery cases.

Can Bond Be Lowered or Changed?

Often, yes. Florida’s rules generally allow the defense to file a motion to modify bond, and the court can hold a bond hearing to reconsider the amount or the conditions. A judge may reconsider a monetary bond if the person is unable to post it. Conditions such as no contact, GPS or curfew can also sometimes be modified when there is a good reason, such as children, work or housing. Every case is different, and a prepared motion that gives the judge real information generally works better than a simple request.

No-Bond Holds and Arthur Hearings

For charges punishable by life in prison or a capital offense, the Florida Constitution allows a person to be held without bond if the proof of guilt is evident or the presumption is great. When this issue comes up, the defense may request what is often called an “Arthur hearing,” named after a Florida Supreme Court case. In general, the State carries the burden at that hearing. Separately, in certain other cases the State can ask the court to hold a person without bond through a motion for pretrial detention. These hearings are fact-heavy, and preparation matters.

Getting Bond Money Back

Cash bond: When the case ends and the person has made all court dates, the bond is generally discharged and the money is returned to the person who posted it. But generally under Florida law, the clerk holds back unpaid fines, court costs, fees and certain costs from a cash bond posted by anyone other than a bondsman. That surprises many families.

Surety bond: The bondsman’s premium is generally not refundable. Collateral is generally returned once the bond is discharged.

Missing court can cause a bond to be forfeited, so make sure the clerk has a current address.

Frequently Asked Questions

Can my family member bond out tonight?

It depends on the charge and the person’s history. Many offenses now require the person to wait for first appearance before any release. If the charge qualifies for a scheduled bond, it can often be posted at the jail.

How much is bond going to be?

Before first appearance, the jail uses the bond schedule. At first appearance, the judge decides based on the factors in Florida law, and the amount can be higher or lower than the schedule, or the person may be released with no money at all.

Do we have to use a bondsman?

No. You can post a cash bond for the full amount, or use a licensed bondsman, who generally charges a nonrefundable premium of around 10%.

Can a lawyer help at first appearance?

Yes. If Attorney Ron Frey is retained, he can appear at first appearance and speak on the person’s behalf about release and conditions.

What if the bond is too high?

An attorney can file a motion to modify bond and request a bond hearing. The court can reconsider the amount and conditions.

Can the no-contact order be changed so they can come home?

Only the court can change it. The alleged victim’s wishes don’t change it on their own. An attorney can ask the court to modify the condition when there’s a good reason.

Will we get our money back?

A cash bond is generally returned when the case ends, minus unpaid fines, costs and fees. A bondsman’s premium is generally not returned.

Below is a general, step-by-step look at how arraignment usually works in Hillsborough County at the time of this writing. Local procedures change and every case is different, so for answers about your own case, call or text Attorney Ron Frey for a free and confidential consultation at (813) 775-2276 or toll-free at (844) 766-3739.

The Laws Involved

In Florida, the arraignment process is generally governed by Rule 3.160, Florida Rules of Criminal Procedure (Arraignment), which addresses how a defendant is formally told of the charges and asked to enter a plea, including the option for a represented defendant’s attorney to file a written plea of not guilty. Related rules include Rule 3.180 (Presence of Defendant) and Rule 3.134 (Time for Filing Formal Charges), which addresses how long the State generally has to formally charge someone after an arrest. Hillsborough County cases are heard in Florida’s Thirteenth Judicial Circuit, which also issues its own administrative orders on how criminal cases are scheduled. Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

The Road From a Hillsborough Arrest to Arraignment

Most Hillsborough County cases follow the same general path:

1. Arrest and booking. A person arrested in Tampa, Brandon, Plant City, or elsewhere in the county is generally booked into one of the county’s jails. 2. First appearance. Anyone still in custody generally sees a judge within 24 hours at first appearance, where probable cause, bond, and release conditions are addressed. 3. The State Attorney’s review. Prosecutors at the Thirteenth Circuit State Attorney’s Office review the reports and decide what charges, if any, to formally file. The charges in court can end up different from the ones listed on the arrest paperwork. 4. Notice of arraignment. Once charges are filed, the clerk generally sends written notice of the arraignment date. People who are still in custody are generally arraigned sooner than people who have been released.

Misdemeanor cases are handled in County Court and felony cases in Circuit Court, but the arraignment step works in a similar way in both.

You Are Generally Required to Attend

In general, a person charged with a crime in Hillsborough County is expected, and ordered, to appear at the arraignment. Missing it can result in the court issuing a warrant for the person’s arrest. No one should read this page and assume they don’t have to go.

The One Exception: A Written Plea and Waiver Your Attorney Confirms

Florida’s rules allow a defendant’s attorney to file a written plea of not guilty and a waiver of arraignment. In Attorney Ron Frey’s general practice, when he is retained, he typically files a written waiver of arraignment along with a written plea of not guilty so the client can be excused from appearing. He takes the steps to confirm that everything was properly filed, submitted to the court, and accepted in time before he confirms that a client does not need to appear.

Unless your attorney has confirmed this for your case, plan to attend your arraignment. Contact Attorney Ron Frey to discuss whether a written plea of not guilty and waiver of appearance can be filed in your case.

If You Go to Arraignment on Your Own

A person without an attorney is expected to attend. The judge generally confirms the charges, addresses the right to an attorney, and asks for a plea. It can be tempting to plead guilty or no contest just to be finished, especially on a misdemeanor, but a plea can leave a lasting record. It is generally wise to speak with an attorney before entering any plea other than not guilty.

After Arraignment: Disposition Dates and Pretrial Dates

Once a not guilty plea is entered, the case moves into the pretrial stage. The defense can request discovery, meaning the evidence the State has, and look at possible motions and options. In Hillsborough County, the next court dates are often called disposition dates or pretrial dates. Diversion programs exist in Hillsborough County, and some people may qualify. Our post on Hillsborough pretrial intervention explains more.

A Short Checklist While You Wait

Keep your release paperwork and any court notices together.

Make sure the clerk has your current mailing address.

Follow every bond and release condition.

Avoid discussing the case on recorded jail calls, by text, or on social media.

Attorney Ron Frey generally advises anyone who has been arrested or contacted by law enforcement to use the right to remain silent and speak with an attorney before making any statement.

Hillsborough Arraignment Questions We Hear Often

I bonded out. Do I still have an arraignment?

Generally yes. Release on bond does not end the case. The arraignment is still set once formal charges are filed, and you are generally required to attend unless your attorney has filed a written plea and waiver that the court accepted, and has confirmed you don’t need to appear.

Can a family member hire an attorney for me?

Yes. Families often make the first call, especially while a friend or family member is still in custody. The attorney still represents the person charged and works with them directly.

What if my arraignment notice never arrived?

Notices can be delayed or sent to an old address. An attorney can check the court record and confirm the date.

What if I miss my arraignment?

Missing an arraignment can result in the judge issuing a warrant for your arrest. If you’ve missed a date, or think you might, call an attorney right away.

Is arraignment the time to tell the judge my side?

Generally no. Arraignment is not the place to explain what happened, and anything said in court can be used later. Your attorney can decide how and when your side is presented.

If you or a friend or family member was just arrested, the arraignment in Florida is usually the next court date you’ll hear about. The word itself can sound intimidating, but the arraignment is a routine early step in a criminal case. It is not a trial, and no one decides guilt or innocence there. Knowing what it is, and what it isn’t, can take a lot of the worry out of the days ahead.

What does arraignment mean? An arraignment is a short, early court hearing in a criminal case. The judge formally tells the accused person the charges and asks for a plea, usually “not guilty.” It is not a trial. No evidence is heard and no one decides guilt. In Florida, a lawyer may file a written not guilty plea instead.

This post explains how arraignment generally works under Florida law, at the time of this writing. Procedures change, so for answers about a specific situation, call or text Attorney Ron Frey for a free, confidential initial consultation at (813) 775-2276 or toll-free at (844) 766-3739.

Related rules include Rule 3.180 (Presence of Defendant), Rule 3.134 (Time for Filing Formal Charges), which addresses how long the State generally has to formally charge someone after an arrest, Rule 3.220 (Discovery), which addresses the exchange of evidence between the prosecution and the defense, and Rule 3.191 (Speedy Trial), which addresses the time limits for bringing a case to trial. Laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.

What an Arraignment Is

An arraignment is generally the court date where a person is formally told what they are charged with and asked to enter a plea. In most cases the plea entered is not guilty, which simply keeps every option open while the defense reviews the evidence. An arraignment is a different hearing from first appearance, which generally happens within 24 hours of an arrest for someone held in custody and deals with probable cause, bond and release conditions.

Where Arraignment Fits in the Timeline

After an arrest and first appearance, the case generally goes to the State Attorney’s Office, which reviews the reports and decides what charges, if any, to formally file. Once formal charges are filed, the clerk generally schedules an arraignment and sends notice of the date. Florida’s rules set time limits on how long the State generally has to file formal charges, and those rules have been updated, which is one more reason to ask an attorney about the timing in your own case.

You Are Generally Required to Attend Your Arraignment

In general, a person charged with a crime is expected, and ordered, to appear at the arraignment. Missing an arraignment can result in the court issuing a warrant for the person’s arrest. No one should read this page, or any website, and assume they don’t have to go.

What Happens at the Arraignment If You Don’t Have an Attorney Yet

A person without an attorney is expected to attend. The judge or clerk generally confirms the charges, explains the right to an attorney, and asks how the person pleads. Someone who can’t afford a lawyer may ask about the public defender. People sometimes feel pressure to “get it over with” by pleading guilty or no contest at arraignment, especially in a misdemeanor case. A plea can have lasting consequences, including a criminal record, so it’s generally wise to speak with an attorney before entering any plea other than not guilty.

What Happens After the Arraignment

Once a not guilty plea is entered, the case generally moves into the pretrial stage. The defense can request discovery, meaning the police reports, videos, witness information and other evidence the State has. Future court dates are set. In Hillsborough County these are often called disposition dates or pretrial dates, while in Pinellas County they are generally called pretrial dates. During this stage, the defense may file motions, negotiate with the prosecutor, or prepare for trial. Diversion programs, such as pretrial intervention, exist, and some people may qualify. You can read more in our posts on Hillsborough pretrial intervention and Pinellas pretrial intervention.

What You Can Do Right Now

Attorney Ron Frey generally advises anyone who has been arrested or contacted by law enforcement to use the right to remain silent and speak with an attorney before making any statement. Keep every piece of paperwork from the arrest and the jail, watch the mail for a court notice, and don’t discuss the facts of the case on recorded jail calls or social media. If you’re choosing a lawyer, our list of questions to ask a criminal defense lawyer can help. Attorney Ron Frey is a Tampa criminal defense lawyer whose office is a short walk from the downtown Hillsborough County courthouses.

Frequently Asked Questions

Do you have to attend an arraignment in Florida?

In general, yes. If you have a court date, plan to go unless your attorney confirms otherwise. Florida’s rules let a represented defendant’s attorney file a written plea of not guilty, and the arraignment is then treated as waived. Some Hillsborough judges also require a filed waiver of the defendant’s appearance. Until your attorney confirms everything was filed and accepted, plan to attend.

Can a lawyer appear for you or file a written plea of not guilty?

Yes, in many cases. Under Rule 3.160(a), an attorney can file a written plea of not guilty at or before the arraignment, and that waives the hearing. Attorney Ron Frey generally files this along with a waiver so the client may not need to appear, and he confirms it was accepted before telling the client so.

How long after an arrest is the arraignment?

It varies. The arraignment is usually set after the State Attorney’s Office files formal charges, and the timing depends on the case and the court’s calendar. Under Rule 3.134, the State generally must file formal charges within 30 days for someone held in custody and within 60 days for someone out on pretrial release, with set extensions if it doesn’t. Your notice from the clerk will show the date.

What happens if you miss your arraignment?

The judge can issue a warrant for your arrest (a capias), and bond may be affected. If you missed a court date or are worried you might, contact a lawyer right away.

Is arraignment the same as first appearance?

No. First appearance generally happens within 24 hours of an arrest for someone held in custody (Rule 3.130). It covers probable cause, bond and release conditions. Arraignment comes later, after formal charges are filed, and is where a plea is entered.

Can charges be dropped at arraignment?

It can happen, but usually not at the hearing itself. Before arraignment, the State Attorney may decide not to file formal charges at all (called a “no information”), or may file different or lesser charges than the arrest charges. After arraignment, the case moves to discovery and pretrial hearings, where an attorney can review the evidence and raise any defenses.
