Arrested for DUI Over the Holidays in Hillsborough County? What Happens Next

Ron Frey

Over Halloween weekend, the Hillsborough County Sheriff’s Office ran a DUI enforcement effort it called Operation Ghost Patrol. Deputies worked across the county and, according to the Sheriff’s Office, made 219 traffic stops, wrote 19 traffic citations and arrested 20 people for DUI. Thanksgiving is a few weeks away, followed by holiday parties, New Year’s Eve and Gasparilla season, and these are busy weekends on Tampa Bay roads. If you or a friend or family member is arrested for DUI in Hillsborough County this season, here is a general look at what comes next.

Why Holiday Weekends Bring More DUI Stops

Law enforcement agencies often put extra deputies and officers on the road around holidays and big events. Halloween showed what that can look like in Hillsborough County. The Sheriff’s Office release described a countywide effort over a single weekend. Thanksgiving Eve, December parties, New Year’s Eve and the Gasparilla events in January and February bring more people out at night, and more stops.

Driving under the influence is covered by section 316.193, Florida Statutes. A stop can start with something as small as a lane change or a burned-out tag light. If you’re planning a night out, a sober driver or a rideshare is the simplest plan. For events downtown, see our pages on arrests at Gasparilla and the Gasparilla Bowl and Lighted Boat Parade.

What Happens After a DUI Arrest in Hillsborough County

After a DUI arrest in Hillsborough County, a person is usually taken to the Orient Road Jail for booking. Some people are released after booking. Others see a judge at first appearance in Hillsborough County within 24 hours, where release conditions are set. The case then moves to an arraignment and later court dates.

Holiday arrests add a timing wrinkle. Courts and offices keep reduced schedules around Thanksgiving, Christmas and New Year’s Day, and a friend or family member may not know when or where the person will be released. An attorney can help answer those questions early. Some first-time DUI cases in Hillsborough County may qualify for the RIDR program, and Pinellas County has its own DROP program. Whether a program is an option depends on the facts and on the prosecutor. For a broader walkthrough, see what happens after a DUI arrest in Tampa and our DUI and traffic defense page.

Your Driver’s License Is a Separate Issue

A DUI arrest can start two tracks: the criminal case in court and an administrative action on your driver’s license. The license side has its own short deadline that begins at the time of arrest, and it can pass quickly, especially over a holiday week. Our Tampa DUI arrest page explains the two tracks. Call an attorney soon after the arrest so that deadline isn’t missed.

Visiting Tampa for the Holidays or Gasparilla

Many people arrested over the holidays live out of town. They came home for Thanksgiving, are visiting family or flew in for Gasparilla. An arrest can raise questions about flights, rental cars and whether a person may leave Florida while the case is open. Release conditions control much of this. In some cases an attorney can ask the court about travel or about appearing through counsel. Our page on being arrested on vacation in Tampa Bay covers this in more detail. Speak with an attorney before changing travel plans.

Phones, Statements and the First Call

After an arrest, people often want to explain what happened to the deputy, post about it or text friends. Statements and messages can end up as evidence. If your phone or other devices come up in the case, speak with an attorney first before you hand them over or agree to a search. The first call should be to a lawyer.

Don’t Rely on the Internet or AI for Your Case

Websites, social media and AI chatbots can give answers that are out of date, wrong for Florida or wrong for your facts. This page is general information, not legal advice. Before you answer questions from police, agree to a search or make decisions about a DUI case, talk with an attorney who can look at what actually happened.
