Driving on a Suspended License in Tampa: When a Ticket Becomes a Crime

Ron Frey

Many people don’t know their license is suspended until an officer tells them. An unpaid ticket in another county, a missed court date, a lapse in insurance, or a child support issue can quietly suspend a Florida license. Then comes a routine stop on Dale Mabry, and suddenly the conversation is about handcuffs instead of a citation. Charges for driving on a suspended license in Tampa are far more common than most people realize.

Cases of driving on a suspended license are among the most common charges in Hillsborough County courtrooms in Tampa. Attorney Ron Frey sees them both as standalone charges and as add-ons to other cases, and he often finds that the most important facts are hiding in a driving record rather than in the police report. (Our DWI and traffic violations page covers related charges.)

The Law: Section 322.34

Driving while license suspended, revoked, canceled, or disqualified is generally addressed under Section 322.34, Florida Statutes. That one section covers a wide range of situations, and the consequences depend heavily on which part applies.

In broad terms:

  • Without knowledge. If a person didn’t know the license was suspended, the offense is generally treated as a noncriminal moving violation.
  • With knowledge. If the person knew, or the State can show they should be treated as knowing, it generally becomes a criminal offense. Repeat offenses can carry escalating consequences, and some can become felonies.
  • Habitual traffic offender. A person designated a habitual traffic offender under Section 322.264, Florida Statutes, who drives while revoked faces a felony charge.

Suspended License Cases in Tampa Often Turn on Knowledge

Because knowledge can be the difference between a ticket and a crime, it is often the key question when someone in Tampa is charged with driving on a suspended license. Florida law allows knowledge to be shown in several ways, such as prior notice from the state, a court order, or a prior citation for the same offense. The State often relies on notice being mailed to the address on file.

That raises practical questions. Did the person move? Was the address current? Was the suspension for a reason the person would have been told about in court? Did the person admit knowledge to the officer at the scene? That last one matters more than people realize. Attorney Ron Frey generally advises that people stopped by police stay calm and contact a lawyer before discussing their license or driving record.

Why the Reason for the Suspension Matters

Not all suspensions are equal. Some arise from unpaid fines or failure to appear, which can sometimes be cleared. Others come from a DUI, a refusal to take a breath test, or points. Some are administrative and some are court-ordered. The reason affects both the defense strategy and what can be done to get the person back on the road. (If the suspension came from a DUI arrest, see our post on a DUI arrest in Tampa.)

Clearing an underlying suspension before court is sometimes possible and can make a meaningful difference in how the case is handled. That is one reason not to wait.

Other Consequences

A suspended-license charge can create additional problems:

  • The car may be towed and impounded.
  • Being on probation and picking up a new charge can trigger a violation. (See Violation of Probation in Tampa.)
  • A conviction can lead to additional suspension time, which can stack on top of the original one.
  • Repeat convictions can lead to habitual traffic offender status and a long revocation.

What Happens Next

When Tampa prosecutors pursue a criminal charge of driving on a suspended license, the case usually moves to an arraignment in Hillsborough County court, where a plea is entered. (Our post What Is an Arraignment in Florida? explains that step.) In many cases, a lawyer can handle much of the early process, and the person may not need to attend every hearing. That depends on the court and the charge.

“I review the stop and pull the driving record. The reason for the suspension and the notice the person got often matter a great deal.”

As always, laws are subject to change and revision, so contact Attorney Ron Frey to discuss the details of your case and the current status of the law.
