The 6th Circuit State Attorney’s Office: Who Prosecutes Cases in Pinellas and Pasco

If you or a friend or family member was arrested in Pinellas or Pasco County, the case will generally be prosecuted by the Office of the State Attorney for the 6th Judicial Circuit. This page explains, in general terms, how that office works. For an overview of every prosecuting office, see Who Is Prosecuting My Case in Florida?
What the 6th Circuit Covers
The 6th Judicial Circuit is made up of two counties: Pinellas, which includes St. Petersburg, Clearwater, Largo and the beach communities, and Pasco, which includes New Port Richey, Dade City and Wesley Chapel. The office is led by an elected State Attorney. Its website describes a team of more than 450 employees, including Assistant State Attorneys, investigators and support staff.
The office lists three locations:
- Pinellas County Justice Center, 14250 49th St. N., Clearwater, FL 33762
- West Pasco County Judicial Center, 7530 Little Road, New Port Richey, FL 34654
- East Pasco County Robert D. Sumner Judicial Center, 38053 Live Oak Ave., Dade City, FL 33523
Who Is an Assistant State Attorney?
Assistant State Attorneys (ASAs) prosecute cases for the State of Florida. According to the office, their job is to review charges and complaints to decide whether the facts support prosecution. ASAs also appear in court, handle negotiations and try cases.
Felony, Misdemeanor and County Court Cases
The State Attorney prosecutes violations of state law in both counties. Felonies are heard in circuit court. Misdemeanors, such as many DUI, petit theft, trespass and disorderly conduct cases, are heard in county court. Both are generally prosecuted by the State Attorney’s Office, whether the arrest was made by the St. Petersburg Police Department, the Clearwater Police Department, the Pinellas or Pasco Sheriff’s Office, or another agency.
Which courthouse handles a case can depend on the county and on where in the county the alleged offense happened. Pasco cases, for example, may be heard in New Port Richey or Dade City. A lawyer can confirm where a case is pending and which prosecutor is assigned.
How a Case Moves Forward
In general terms:
- Arrest and booking at the county jail.
- First appearance before a judge, where release and bond are addressed.
- Filing decision by an ASA.
- Assignment to a courtroom division.
- Arraignment and later court dates. See also what an arraignment is in Florida.
Diversion and Specialty Programs
The 6th Circuit State Attorney’s Office lists several programs on its website, including Pre-Trial Intervention (PTI), Drug Court, Veterans Treatment Court, Mental Health Court (Pinellas), a DUI program called D.R.O.P., and a Bad Checks Diversion Program. The office says its input and victim approval are required for program acceptance, along with restitution where it applies. Whether any program fits a particular case depends on the facts. A lawyer can explain the options.
Communicating With the Prosecutor
A lawyer handles communication with the prosecutor. If you face any stop, search, seizure, inquiry, investigation, arrest or target letter, contact a lawyer.
